updates.climateinitiative.com.au

Climate Initiative is operated by Eco Green Group Pty Ltd ACN 657 510 766 as trustee for the Griffiths Family Trust, operating under the registered business name Climate Initiative.

In these Terms, Climate Initiative, we, us and our refer to that business.

Contact: [email protected]

By accessing or using the Climate Initiative website, you agree to these Terms.

If you do not agree with these Terms, you should not use the website.

2. Climate Initiative is currently under development

Climate Initiative is currently developing a climate certification program and related standards, systems, services and resources.

Information published during this pre-launch period is intended to explain the development and intended direction of Climate Initiative and to allow interested people and organisations to follow its progress.

Program architecture, certification requirements, terminology, eligibility criteria, methodologies, processes, pricing, governance arrangements, trade marks, certification marks, launch timing and other features may change before launch.

Unless expressly stated otherwise, pre-launch information should therefore not be interpreted as a final rule, standard, certification requirement, contractual commitment or representation that a particular future service will be offered in its current proposed form.

3. Joining the pre-launch contact list

You may choose to join the Climate Initiative pre-launch contact list by providing the information requested through our signup form.

You must provide an email address that you are authorised to use.

Climate Initiative currently uses an email confirmation process before treating a person as a confirmed subscriber.

Submitting the signup form or confirming your email address does not:

  • constitute an application for certification;

  • create membership of Climate Initiative;

  • guarantee access to any future Climate Initiative product, program or service;

  • create any certification or approval status;

  • create a contractual relationship for certification services; or

  • confer any right to use Climate Initiative branding, trade marks or certification-related marks.

You may unsubscribe from marketing communications at any time using the unsubscribe facility provided in our emails.

4. No certification is granted through this website

Nothing on this website represents or implies that any person, organisation, product, service, building, portfolio, event or other subject has been certified, approved or endorsed by Climate Initiative unless Climate Initiative expressly states otherwise.

Visiting the website, joining the contact list, receiving communications from Climate Initiative or participating in pre-launch activities does not create any certification status.

Any future certification will be subject to the applicable standards, rules, eligibility requirements, agreements, assessment processes and approval procedures in force at that time.

5. Certification-related materials may be provisional

Climate Initiative is still developing its certification program.

Certification-related names, marks, terminology, descriptions, criteria, methodologies, pathways, processes and other materials published during the pre-launch period may therefore be provisional.

Unless expressly identified as final and effective, such material should not be relied upon as representing the final form of the Climate Initiative certification program.

Climate Initiative may amend, replace or withdraw pre-launch materials as the program develops.

6. General information only

Information on this website is provided for general informational purposes.

It does not constitute legal, accounting, tax, financial, investment, engineering, scientific, carbon-accounting or other professional advice.

You should obtain appropriate professional advice before making decisions that depend on your particular circumstances.

Nothing on this website creates a professional adviser-client relationship between you and Climate Initiative.

7. Accuracy and changes

Climate Initiative aims to provide clear and accurate information.

However, because Climate Initiative is under active development, information may:

  • change over time;

  • become outdated;

  • be incomplete during the development process; or

  • be replaced by later published material.

We may modify, update, remove or replace website content without notice.

Nothing in these Terms excludes or limits any obligation Climate Initiative may have under applicable Australian law, including obligations relating to false or misleading representations.

8. Intellectual property

Unless otherwise stated, content made available through the Climate Initiative website, including text, graphics, designs, logos, branding, methodologies, documentation and other materials, is owned by, licensed to or used with permission by Climate Initiative or the relevant rights holder.

You may view, download or print website material for legitimate personal or internal business information purposes.

Unless permitted by law or with prior written permission, you must not:

  • reproduce, republish or distribute substantial website content;

  • commercially exploit Climate Initiative materials;

  • modify Climate Initiative content in a misleading way;

  • remove copyright, trade mark or proprietary notices;

  • use Climate Initiative branding in a manner suggesting certification, approval, affiliation or endorsement;

  • imitate, copy or misuse Climate Initiative certification-related marks; or

  • represent that you have been granted rights that have not been expressly provided to you.

No licence to use any Climate Initiative trade mark, certification mark, logo or other protected branding is granted merely because you access or use this website.

9. Acceptable use

You must not use the website in a way that:

  • is unlawful, fraudulent or misleading;

  • infringes the rights of Climate Initiative or another person;

  • interferes with the operation, availability or security of the website;

  • attempts to obtain unauthorised access to systems, accounts or data;

  • introduces malware, malicious code or other harmful material;

  • impersonates Climate Initiative or another person;

  • falsely represents that a person, organisation, product or service is certified, approved or endorsed by Climate Initiative;

  • misuses Climate Initiative branding or intellectual property; or

  • uses automated systems in a manner that materially disrupts the website or infringes our rights.

We may restrict or block access where we reasonably believe use of the website is unlawful, harmful or inconsistent with these Terms.

10. Third-party services and links

The Climate Initiative website may contain links to third-party websites, platforms, resources or services.

Third-party services operate independently and may have their own terms, privacy policies and practices.

A link from the Climate Initiative website does not necessarily constitute endorsement, approval or recommendation of the third party or its products or services.

To the extent permitted by law, Climate Initiative is not responsible for the content, security, availability or practices of third-party websites or services.

11. Privacy

Climate Initiative handles personal information in accordance with the Climate Initiative Privacy Policy and any privacy collection notice displayed when information is collected.
By providing personal information to Climate Initiative, you acknowledge that it will be handled in accordance with that Privacy Policy and applicable law.

12. Website availability

We may modify, suspend, restrict or discontinue all or part of the website from time to time.

We do not guarantee that the website will always be:

  • continuously available;

  • uninterrupted;

  • error-free;

  • secure; or

  • compatible with every device, browser or system.

We may undertake maintenance or make technical changes without prior notice.

13. Liability

To the maximum extent permitted by law, Climate Initiative is not liable for loss arising solely from reliance on information that has been clearly identified as preliminary, provisional, pre-launch or subject to change.

To the maximum extent permitted by law, Climate Initiative excludes liability for indirect, incidental, special or consequential loss arising from:

  • use of the website;

  • inability to access the website;

  • reliance on preliminary website material; or

  • third-party websites or services linked from the website.

Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified, including any rights that may apply under the Australian Consumer Law.

14. Future Climate Initiative products and services

These Website Terms apply to the current pre-launch website and general online information services.

They are not intended to govern future:

  • certification applications;

  • certification agreements;

  • membership or participation arrangements;

  • assurance-practitioner arrangements;

  • paid products or services;

  • marketplace transactions;

  • software services;

  • data services; or

  • licences to use Climate Initiative intellectual property or certification marks.

Separate rules, contracts, policies or terms may apply to those activities when they are introduced.

Where specific terms governing a Climate Initiative service conflict with these general Website Terms, the specific terms will apply to that service to the extent of the inconsistency.

15. Changes to these Terms

Climate Initiative is currently under development and its activities are expected to expand.

We may update these Terms as our website, services, business structure, legal obligations or operating arrangements change.

The current version of these Terms will be published through the Climate Initiative website.

16. Governing law
